@ 130rapid: AJ-577-XY was given in January 2010. I assume your "extra" infos are coming from an insurance website. As explained in the forum some months ago, the only allowed information that can be publicly displayed about a French plate number is the date on which it was given. I wonder therefore how competent and trustworthy is a company which apparently don't know what it is really doing (nor that it risks a € 300,000 fine)... |

I don't think they could have made that engine size up. I don't see why we should not use an info that we get for free. It's their fault for making additional info public, but it seems real considering the Renault Master really did have a 2188cc engine. They don't even display the complete VIN so I don't see the risk. |

To make it short, and according to the French law (fr) and its interpretation (fr), we should have a license to use these infos and we risk a € 300,000 fine as we display them publicly: (All re-users of public informations coming from the SIV must have a license assigned by the The Ministry of the Interior) And: (If rules are not respected, there are penalties up to € 300,000) So should we just say "we're innocent because we got these infos for free"? On a legal level, what we make is an unlawful use of data: I don't say I agree with this idea, I just remind here what the French law says... I hope antp has enough money for the fine ![]() |

I'm not sure in which case we are here, but for us posting the date is indeed probably enough, especially if it is the only part that can be publicity posted without risk |

The insurance/spare parts pages give you limited access to SIV database. You can get selected datas about vehicles only, not informations about owners. That's this law clou. ![]() |

Which is illegal. As explained above, the law says: All re-users of public informations coming from the SIV must have a license assigned by the The Ministry of the Interior. IMCDb doesn't have this license, and there's no "fair use" in French law, so we shouldn't use nor display other details than the registration date from 2009+ plates. |

Thank you for explanation! ![]() |

This site, which is hosted in French servers, likely also doesn't have a permission to use all the images hosted here and as the concept of "fair use" is likely unique to US law , so really, where's the problem? |

Among other things, accumulating too many unlawful behaviors could just lead to the IMCDb closure? Since 2004 and the LCEN (Loi pour la Confiance dans l'Économie Numérique / Law for Confidence in the Digital Economy), French website hosts have a direct interest in "cutting off the power" as soon as someone complains about illicit content (or said to be so), otherwise their penal and civil responsibility can be engaged. So the fewer the "faulty behaviors" are, the longer the IMCDb can stay "out of sight"? And it's certainly easier to deal with private companies (film owners that could see an advantage in having their movies promoted through the identifications in the IMCDb) than with the French administration (predictable ending of the negotiations: site closure and a € 300,000 fine for the site manager) ![]() -- Last edit: 2017-02-27 21:40:17 |

It is not explicitly illegal to use static captures of images, unlike publishing info from plates which is apparently explicitly illegal. As I said above, posting the date is enough for us, so why post the rest? Someone (me or admins ![]() -- Last edit: 2017-02-27 21:46:59 |

It could be useful to keep this exchange somewhere in the admin part of the forum (or to archive it?) in order to avoid repeating the same info every 6 months ![]() By the way, and just to be sure of which dates can be published, the only lawful and publicly available info is the registration date of the plate. So pre-2009 details found on insurance websites thanks to the 2009+ SIV registration (like the 2003 MY of the vehicle in this page) are out of the scope. As usual, I don't say that I agree with that, I just remind the current French law ![]() -- Last edit: 2017-02-28 00:03:02 |

I do it with my comments, by cancelling exact info, however not gained knowledge... |
